Committee of Adjustment

Mandate

The Committee of Adjustment is a statutory tribunal with authority delegated to it by Loyalist Township Council, under the provisions of the Ontario Planning Act, R.S.O. 1990 c. P. 13, to hold public hearings to make decisions on applications submitted to Loyalist Township for minor variances, alterations to legal non-conforming uses, and consents. The Committee operates independently from Council and its decision may be appealed to the Ontario Land Tribunal. It is the responsibility of the Secretary-Treasurer of Development Services to accept all applications for processing, upon submission by the applicant.

Applications to the Committee of Adjustment will be processed in accordance with the requirements of Section 45 and Section 53 of the Planning Act, applicable regulations (O. Reg 200/96 as amended and O. Reg 197/96 as amended), the Statutory Powers Procedures Act and the Committee of Adjustment procedure.

The Committee is authorized by the Planning Act to consider applications for:

Minor variances from the provisions of the Zoning By-law;
Extensions, enlargements or variations of existing legal non-conforming uses under the Zoning By-law; and,
Determine whether a particular use conforms with the provisions of the Zoning By-law where the uses of land, buildings or structures permitted in the by-law are defined in general terms.

Meetings

Committee of Adjustment meetings will be held once a month. The meeting, agenda and minutes will be available on the CivicWeb Portal. Members of the public may participate electronically as requested, in accordance with the Procedural By-Law.
